Quick answer: Pick by the person, not by the product. In Maine, an adult 21 or over may give another adult 21 or over up to 2.5 ounces of cannabis, as long as no money changes hands. A cannabis gift is simply product handed over for free. You cannot mail it, and you cannot buy it for a minor.

Key takeaways:

  • Title 28-B M.R.S. section 1501(1)(C) allows transfer of up to 2.5 ounces of cannabis to another adult 21 or over, without remuneration.

  • Taking money, a donation or a swap turns a gift into a sale, which only licensed stores may do.

  • USPS Publication 52 section 453.35 bars mailing anything unlawful under the Controlled Substances Act, so mailing it is out.

  • Maine caps an edible serving at 10 mg THC and a package at 200 mg THC (Title 28-B section 703), which sets your dose choices.

  • The adult-use sales tax rate rises to 14 percent from 1 January 2026 under 36 M.R.S. section 1811.

What are the best weed gift ideas at a glance?

Start with the recipient, then pick a category. Most bad cannabis gifts come from buying a thing you liked, then hoping it fits.

Here is the shortlist we hand people at the counter in December.

Recipient Category to buy Budget band Mistake to avoid
Already has everything Minor cannabinoid products, such as a CBN or CBG blend Mid More flower. They have flower.
Only drinks alcohol A low dose THC beverage, in a format they recognize Low to mid A 10 mg edible as the swap
Curious but nervous 2.5 mg or 5 mg edibles, or one sippable drink Low Anything they have to light
The host A multipack of drinks, plus a bag of ice Mid One big item nobody can share
The outdoors person Pre-rolls or a small concentrate, plus a hard case Low to mid Glass that breaks in a pack
You barely know them A gift card, or nothing Any Guessing a dose for a stranger

Two rules sit behind every row. Buy the format they already use, and buy the dose you would want on your worst day.

Can you legally give cannabis as a gift in Maine?

Yes, and the rule is clearer than most people expect. Title 28-B M.R.S. section 1501(1)(C) lets an adult 21 or over transfer or furnish up to 2.5 ounces of cannabis to another adult 21 or over, without remuneration.

That phrase does the work. The statute counts donations and any monetary payment, direct or indirect, as remuneration. Five dollars for gas, a Venmo request, a swap for a bottle of wine: all of those make it a sale.

Question Short answer Where it comes from
Hand cannabis to an adult 21 or over Yes, up to 2.5 ounces, free 28-B M.R.S. section 1501(1)(C)
Take money, or a donation No. That is a sale Same paragraph, "without remuneration"
Mail or courier it No USPS Publication 52 section 453.35
Buy it for someone under 21 No Section 1501 covers adults 21 or over only
Give immature plants Up to 6 immature plants or seedlings 28-B M.R.S. section 1501(1)(D)
Carry it in the car with you Yes, but no open container in the passenger area 29-A M.R.S. section 2411 applies to driving

The 2.5 ounce figure is also your own purchase and possession limit, with no more than 10 grams of concentrate in it. Your gift comes out of that limit, not a separate allowance. We walk through the full numbers in our guide to Maine possession and purchase limits.

Why you cannot mail it

Cannabis is still a controlled substance under federal law. USPS Publication 52 section 453.35 states that any article deemed unlawful under the Controlled Substances Act is prohibited from mailing. Private carriers follow the same line.

Our license also stops at the Maine border. So a gift for your cousin in Boston is a gift you hand over in Maine, or it is not this gift at all.

What do you buy for someone who already has everything?

Buy a cannabinoid they have not tried, not a bigger version of what they have. Regulars tend to own every device and still have never sat down with a CBN or CBG blend.

Minor cannabinoids are the one category where a heavy user is a beginner again. Our explainer on CBN, CBG and THCV is the brief to read first.

Avoid buying more flower. They have a preferred strain, a preferred grower and a preferred price. You will not beat it, and they will be polite about it.

What works for a person who only drinks alcohol?

Give them a drink. Beverages are our signature category because they fit the habit an alcohol drinker already has: a cold can, a glass, a sip at a time.

Dose control is the real gift here. A sipper can stop halfway through a can. Nobody can stop halfway through a gummy they already chewed.

Start low. Then point them at our comparison of THC drinks and alcohol so they know what the swap actually feels like.

What to avoid: a 10 mg edible handed over at a party. That is a full Maine serving, it takes hours to arrive, and it is the single most common way a first night goes badly.

What should you buy for someone curious but nervous?

Buy the smallest dose in the shop and write the plan on the tag. Nervous people do not need more product. They need permission to take a tiny amount and stop.

Our Maine edible dosage chart exists for exactly this gift. Pair it with a note: half a serving, then nothing for two hours.

Then tell them they can come in with you. A first visit with someone who knows the counter beats any product. Our guide to a first dispensary visit covers the ID check, the queue and the questions staff will ask.

Avoid anything they have to light. A nervous person plus an unfamiliar flame is a bad first memory.

What is the right gift for a host or an outdoors person?

For a host, buy a multipack of drinks so the gift can be shared without anyone guessing a dose. One can each, visible labels, no cutting gummies in half in a kitchen.

A cold multipack and a bag of ice beats one expensive item nobody opens. If seltzers are the plan, our rundown of THC seltzers in Portland is the honest version.

For the outdoors person, think about the pack, not the product. Pre-rolls and small concentrates survive a day on a trail or a chairlift. Glass does not.

If their December is pointed at the mountains, our notes on cannabis near Sunday River and Sugarloaf cover what travels and what stays home. Maine lets towns opt out of adult-use sales, so check the town before assuming there is a shop near the hill.

Who should you not buy cannabis for?

Anyone under 21, full stop. Every allowance in section 1501 is written for adults 21 or over, and section 1504 adds forfeiture plus any other penalty that applies. Our counter cards every customer, every visit.

Skip it for anyone who has not asked. A surprise cannabis gift to a person who has never mentioned it puts them on the spot in front of family.

Skip it for someone on prescription medication, or working through a health question. Send them to a provider who knows their history, not to a gift bag.

And think about the house it lands in. If there are children or pets, put a lock in the gift bag too. Our piece on safeguarding a stash from curious kids is the least festive and most useful thing here.

Is a gift card the cleaner option?

Usually, yes. A gift card moves the purchase into the recipient's name, under their own ID and their own 2.5 ounce limit. They choose the product and the dose, which is the part gift buyers get wrong most often.

It also sidesteps the awkward cases. No shipping, no guessing, no handing a sealed package to someone who turns out to be 20.

What a store can issue depends on its license, so ask us at the counter or call the shop before you plan around it. We would rather tell you on the phone than at the register on 23 December.

Does the new Maine cannabis tax change your December budget?

It can, if you are splitting a gift across two months. The adult-use cannabis sales tax rate rises to 14 percent from 1 January 2026 under 36 M.R.S. section 1811.

That is worth a thought if you are costing out a December present against a January one. It does not change what is on the shelf, and it does not change the 2.5 ounce limit.

If you shop with us often, the Amplify 2.0 loyalty program is the lever that actually moves a December bill.

Where do you shop for this in Portland?

Come to our counter at 327 St John St in Portland and tell us who the gift is for. That one sentence gets you further than any list.

Our stock changes week to week, and the online menu is the only honest record of it. Browse the Rose Mary Jane menu before you drive over, or check hours and directions on our Portland store page.

If the gift is an edible, read our companion piece on how long edibles last before you write the tag. The duration surprises people more than the dose does.

Frequently asked questions

Can I legally give weed to a friend in Maine?

Yes, within limits. Title 28-B M.R.S. section 1501(1)(C) lets an adult 21 or over transfer or furnish up to 2.5 ounces of cannabis to another adult 21 or over, without remuneration. Without remuneration means no money, no donation and no swap for goods or services. The moment you take anything of value, it stops being a gift and becomes a sale. Only licensed stores may sell.

Can Rose Mary Jane ship a cannabis gift to another state?

No. Cannabis is still a controlled substance under federal law, and USPS Publication 52 section 453.35 says any article unlawful under the Controlled Substances Act is prohibited from mailing. Private carriers apply the same rule. Our Maine license also stops at the state line. If your person lives out of state, buy them something legal to mail and save the cannabis for a visit.

Is a gift card a better cannabis gift?

Often, yes. A gift card keeps the purchase in the recipient's name, inside their own 2.5 ounce limit, with their own ID at the counter. They also pick the product and the dose, which is the part most gift buyers get wrong. Ask us at the counter or call the shop to confirm what we can issue, because what a store can put on a card is set by its license.

What is a safe first dose to put in a gift?

For an adult with no tolerance, aim low. Maine caps an edible serving at 10 mg THC and a package at 200 mg THC under Title 28-B section 703. A 10 mg serving is a full dose, not a starter dose. Many first timers do better on 2.5 mg or 5 mg, or on a low dose drink they can sip. Write the suggested starting amount on the gift tag.

Can I buy cannabis for someone under 21?

No. Every allowance in Title 28-B M.R.S. section 1501 applies to adults 21 or over, including the gifting paragraph. Handing cannabis to anyone younger falls outside the law, and section 1504 adds forfeiture of the product plus any other penalty that applies. Our counter cards everyone, every visit. There is no version of this that works, so pick a different present.

Does the Maine cannabis tax change in January 2026?

Yes. The adult-use cannabis sales tax rate rises to 14 percent from 1 January 2026 under 36 M.R.S. section 1811. That matters if you are costing out a December gift against a January one, or if you plan to buy in two trips. It does not change what is on the shelf. Ask us at the register and we will show you the tax line on your receipt.
