How Much Cannabis Can You Buy and Carry in Maine?

Quick answer: Maine cannabis possession limits let an adult 21 or older carry up to 2.5 ounces of cannabis, and no more than 10 grams of that total can be concentrate. A licensed store can sell you that same amount per transaction. Edibles and THC drinks are capped at 10 mg of THC per serving and 200 mg per package. The concentrate and package caps rose in October 2023.

That date matters. Plenty of pages still quote the old 5-gram concentrate limit and three-plant home grow cap. Both are out of date. Everything below comes from the current text of Title 28-B and the Maine Office of Cannabis Policy (OCP).

Concentrate isn't extra room on top of the 2.5 ounces. It's a smaller bucket inside the big one.

How much flower can you legally carry in Maine?

You can carry up to 2.5 ounces of flower at any one time if you're 21 or older. That's roughly 70.9 grams, whether it's in your bag or your coat pocket on Commercial Street.

"At any one time" does real work there. The law caps what you have on you, not what you bought this week.

How much can you buy at a Maine dispensary in one visit?

A licensed cannabis store can sell you up to 2.5 ounces, with no more than 10 grams of concentrate, in any single sales transaction. That's 28-B §504, echoed in OCP rule 18-691 CMR Chapter 30.

There's no separate "daily" cap in the statute. The possession ceiling does that job, because once you walk out the door, two purchases still can't add up to more than 2.5 ounces on you.

One small exception: nonedible products with no THC in them, like a CBD-only lotion, don't count toward the transaction limit.

What does 2.5 ounces actually look like?

More than most people picture.

In eighths

An eighth is 3.5 grams. Twenty eighths make 70 grams, just under the line. Twenty-one would put you over.

In pre-rolls

The limit works out to 70 one-gram pre-rolls, or 141 half-grams. Infused pre-rolls are a gray area: Maine's rules don't spell out how the concentrate inside counts toward the 10-gram sub-limit, so if you're buying a lot of them, ask us at checkout. A mixed basket

This basket stays legal:

Add six more one-gram carts and you'd break the concentrate cap while still under 2.5 ounces total. It's the easiest way to go over, and it's usually vapes.

How do edibles and THC drinks count toward the limit?

Edibles and drinks are limited by THC per serving and per package, and the concentrate inside them counts toward your 10 grams by the weight of the concentrate alone, not the weight of the brownie. That second part comes from the definition of cannabis concentrate in 28-B §102-A, which says the other ingredients aren't included when you weigh the concentrate in a product.

A 12-ounce can of THC seltzer doesn't count as 12 ounces of anything.

The per-package math

  • One serving can hold no more than 10 mg of THC.
  • One package can hold no more than 200 mg, so a maxed-out package is 20 servings.
  • Before October 25, 2023, the package cap was 100 mg, so older guides quoting that number are out of date.

THC drinks are edible cannabis products under Maine law (the definition covers "any type of food, drink or pill"), so the same caps apply. Pair this with how long THC drinks take to kick in, because label math and timing in your body are different problems.

What we can't give you

Maine doesn't publish an official "one package equals X grams" chart, and we won't invent one. As rough arithmetic only, a 200 mg package made with distillate holds well under half a gram of concentrate, so edibles rarely hit the cap alone. Stacked with vapes and dabs, they can. How is home-grown cannabis treated?

If you grow at home, you can keep all the cannabis your plants produce, as long as it stays at your residence or the place where it was grown. The plant limit is 6 mature, 12 immature and unlimited seedlings per adult, up from 3 mature plants before October 25, 2023.

The catch is the word "at." Off that property, the ordinary 2.5-ounce limit applies again. Plants must be tagged, hidden from public view and secured from anyone under 21, and butane extraction at home is banned under §1503. How are medical patient limits different?

Medical patients in Maine can possess up to 8 pounds of harvested cannabis, under Title 22, section 2423-A. A caregiver can transfer up to 2.5 ounces to a patient in one transaction, and visiting out-of-state patients are held to 2.5 ounces per 15-day period.

What happens if you go over the limit?

Carrying more than 2.5 ounces is a crime in Maine, not a ticket. Under 17-A M.R.S. §1107-A, over 2.5 and up to 8 ounces is a Class E crime, punishable by up to six months in jail and a $1,000 fine. Over 8 ounces is Class D, and past a pound, Class C. The excess can be seized (28-B §1504), and over 2.5 ounces lets a court infer furnishing (17-A §1106). This is a summary, not legal advice.

Lighter violations are civil. Public consumption is a fine of up to $100 under §1501(2). Under-21 possession is a $350 to $1,000 civil fine depending on amount, under 22 M.R.S. §2383. Where you can legally use it is covered in where can you smoke weed in Maine.

What ID do you need to buy?

You need a valid, unexpired, government-issued photo ID showing you're 21 or older. A driver's license, state ID or passport works, including out-of-state ones. Visitors should read our Maine cannabis laws for tourists, because crossing a state line with cannabis is a federal problem.

Do edibles count toward the 2.5-ounce limit?

The concentrate inside an edible counts toward your 10-gram concentrate limit, weighed without the other ingredients. So a gummy's gelatin or a seltzer's water doesn't count.
