Quick answer: In Maine, you can legally smoke weed only in a private residence (including its yard, porch and deck) or on private property where the owner has explicitly said yes. Real life is messier: a West End lease, an Airbnb on Peaks Island, a cousin who thinks a brewery patio counts as "outside." Here's the place-by-place version, checked against the statutes as of September 2026.
What does Maine law actually allow?
Adults 21 and over may consume cannabis in only two kinds of places: a private residence, including its curtilage, and private property that isn't generally open to the public, with the owner's explicit permission. That's Title 28-B, section 1501.
"Curtilage" is the legal word for the yard, porch and deck around a home. It's why your backyard is fine and the sidewalk six feet away isn't.
Exceptions: no consumption in a vehicle on a public way, at a home day care during its hours, or anywhere Maine's smoking law already bans smoking. The Maine Office of Cannabis Policy (OCP) is blunt on its FAQ page: use "in any form, including smoking, eating, or vaping, is prohibited in public places."
Note the word eating. Edibles are not a public loophole. Break the rule and it's a civil violation with a fine of up to $100, plus any Portland city citation. Not a crime, but a bad way to spend a Saturday on Commercial Street.

Can you smoke weed in a rental apartment in Maine?
Yes, if your lease allows it. Your landlord owns the property, and a no-smoking lease is the owner saying no.
Maine also requires disclosure. Under Title 14, section 6030-E, residential landlords must tell you in writing whether smoking is banned, allowed, or allowed only in certain areas, and get your signed acknowledgment before you pay a deposit. The answer is probably already in a folder somewhere. Read the wording. Many leases say "any substance" and name vaping, and Portland's code (section 17-114) lets landlords restrict marijuana smoking with posted signs. A smoke ban usually isn't aimed at a gummy in your kitchen, but some leases ban cannabis outright.
Can you smoke weed in a hotel or Airbnb in Maine?
Almost never in a hotel, and only with the host's explicit permission in an Airbnb. Maine used to exempt rented hotel and motel rooms from its indoor smoking ban. That exemption in Title 22, section 1542 was repealed effective January 5, 2026, and hotels set their own no-smoking policies on top of it, often with a cleaning fee attached.

Can you smoke weed in a car in Maine?
No. Maine bans consumption by the driver or any passenger of a vehicle on a public way, so the back seat on I-295 is no safer than the wheel. Smoking anything with a minor in the car adds a $50 traffic infraction under Title 29-A, section 2120.
Operating under the influence is a crime whether the cause is alcohol or cannabis. Don't drive high, and don't ride with someone who is. Maine's open container law covers alcohol only, but carry your purchase sealed in the trunk anyway.
Can you smoke weed on a Maine beach or in a state park?
No. State parks and beaches are public places. Title 22, section 1580-E also bans smoking "tobacco or any other substance" on or within 20 feet of any beach, playground, picnic shelter or restroom in a Maine State Park, which covers Crescent Beach, Two Lights and Scarborough Beach.
Portland adds its own layer. City code section 17-91 bans smoking at and within 20 feet of city beaches, playgrounds and athletic fields, and section 17-96 bans it in city parks including the Eastern Promenade, Back Cove, Deering Oaks and Baxter Woods. The city's definition of smoking includes vapes. You get one verbal warning before a citation, which is a courtesy, not a plan.
Can you smoke weed in Acadia National Park?
No. Acadia is federal land, and the National Park Service says use and possession of marijuana in the park are prohibited by federal law. Maine's adult-use law doesn't reach there, or Katahdin Woods and Waters National Monument.
In April 2026 the Justice Department moved FDA-approved and state-licensed medical marijuana products to Schedule III. A DEA hearing on broader rescheduling ended in July 2026 without a decision, so adult-use cannabis is still federally illegal. Leave it at your Bar Harbor rental.
What about the Casco Bay ferry and the islands?
Not on the boat and not at the terminal. A ferry isn't private property closed to the public, and Portland's code specifically bans recreational marijuana use on transportation infrastructure. On Peaks, Cliff or Long Island, mainland rules apply: a residence or a rental whose owner says yes.
Are there cannabis lounges in Maine?
No. As of September 2026, Maine has no licensed social consumption lounges. The 2016 ballot measure that legalized adult use included social clubs, but the Legislature's 2018 rewrite dropped them. LD 1365, a bill to allow locally approved lounges, was rejected by the Maine House 108 to 35 on April 6, 2026.
