Quick answer: Yes, but two different products share the name. Maine licensed adult-use THC drinks are sold only in 21 and over stores like ours, capped at 10 mg of THC per serving, and lab tested under state rules. Hemp derived THC drinks sit under a separate state and federal framework that is changing fast.

Key takeaways:

  • A licensed Maine THC drink is capped at 10 mg of THC per serving and 200 mg per package.

  • Maine law sets no milligram cap on hemp derived drinks, only a 21 and over sale rule.

  • Licensed drinks must pass state required potency and homogeneity testing on every batch.

  • Consuming any cannabis product in public is a civil violation in Maine, fined up to 100 dollars.

  • Federal hemp rules are mid change. The effective date has already moved once, so ask us.

THC drinks in Maine at a glance

A THC drink is a beverage infused with THC, the compound in cannabis that makes a person feel high. Two very different products go by that name. One is a licensed adult-use beverage from a store like ours on St John St. The other is a hemp derived drink from a corner store cooler, a bar fridge or a website.

They look the same in a can. They are not the same product in law.

What differs Licensed Maine adult-use drink Hemp derived THC drink
Who regulates it Maine Office of Cannabis Policy Maine hemp program under Title 7, plus federal law
Where it is sold Licensed 21 and over stores only Corner stores, bars, liquor stores, online

Sales tax treatment Adult-use cannabis tax Ordinary retail sales tax

Our deeper breakdown of hemp THC drinks versus dispensary THC drinks walks through what that table means at the shelf.

What makes a Maine licensed THC drink different?

A licensed drink is made, tested, tracked and sold inside one closed state system. The Maine Office of Cannabis Policy licenses the grower, the maker, the lab and the store. Every can moves through the state inventory tracking system before it reaches our cooler.

That is why you show ID at our door. It is also why we cannot sell you a can to go with a meal somewhere else.

The rules sit in Title 28-B of the Maine statutes and in the agency rules at 18-691 CMR. The same chapter that governs a gummy governs a seltzer, because Maine counts an infused drink as an edible cannabis product.

What are the milligram caps on each drink?

A licensed Maine beverage is capped at 10 mg of THC per serving and 200 mg per package. Maine raised the package cap from 100 mg to 200 mg in October 2023. The per serving figure did not move.

Hemp derived drinks have no Maine milligram cap at all. Title 7, section 2231 defines a potentially intoxicating hemp product by percentage, not by milligrams. So a hemp can holding 25 mg and a hemp can holding 100 mg are both outside any state serving limit.

A state working group did recommend a 5 mg cap on hemp beverages in its November 2024 letter, reported by The Maine Monitor. Maine has not enacted that cap. Our edible dosage chart for Maine is a safer starting point than a can's front label.

What testing does each kind of drink go through?

Licensed drinks go through required lab work. Hemp drinks do not, at least not because Maine says so.

Maine's mandatory testing rules sit at 18-691 CMR chapter 40. Every batch of a licensed edible, drinks included, must be tested for potency and homogeneity. Homogeneity matters in a beverage, because THC does not mix into water on its own.

Contaminant work covers residual solvents, pesticides and metals. Under guidance issued by Office of Cannabis Policy director John Hudak in April 2026, an edible is exempt from repeat contaminant testing when the concentrate used to make it already passed those panels.

Maine's hemp statute requires no finished product panel for a hemp seltzer. If a hemp brand publishes a lab report, that is the brand's choice, not a state rule. Learning how to read a Maine cannabis label tells you quickly which kind of can you are holding.

Who can buy each one, and where?

Licensed drinks are sold only by licensed 21 and over stores. Hemp derived drinks are sold almost anywhere, with a 21 and over sale rule on top.

That hemp age rule is recent. LD 1920 became Public Law 2025 chapter 416 and took effect on 24 June 2025. It added section 12 to Title 7, section 2231: a potentially intoxicating hemp product may not be sold to a person under 21.

Before that, Maine had no age floor in statute. The Maine Monitor quoted the state working group's finding that Maine law provided no mechanism for limiting access.

Where is federal hemp law heading?

The direction of travel is a much tighter federal cap on hemp THC. We will not state a settled outcome for a date, because the date keeps moving.

Here is what is genuinely settled. A November 2025 appropriations package, Public Law 119-37, redefined hemp. Under that language a finished product with more than 0.4 mg of total THC per container is no longer federal hemp. The cap is per container, not per serving.

Here is what is unsettled. HR 6500 was signed on 2 September 2026 and pushed most of those restrictions from 12 November 2026 to 11 December 2026. Other bills in Congress would delay it to 2028, repeal it, or carve out beverages and regulate them like alcohol. None of those had passed when we last checked.

Can you take a THC drink into a bar, a park, a plane or your car?

Mostly no, and the reasons differ by place. Maine allows consumption in a private residence, or on private property not generally open to the public when the owner gives explicit permission. That is Title 28-B, section 1501.

Where Allowed? Why
Bar or restaurant No Open to the public, so outside the statute. Venues also set their own rules
Eastern Promenade or any Portland park No Public place. Civil fine up to 100 dollars
Restaurant patio No Maine bans smoking in outdoor eating areas under Title 22, section 1550
Flying from the Jetport No Cannabis is still federally controlled
In the mail No USPS lists cannabis as nonmailable matter
Open can in the car No Open containers in the passenger area are prohibited
Private rental, host says yes Usually Private property with the owner's permission

Two details worth spelling out. TSA states its officers do not search for drugs, but they refer anything illegal to law enforcement. Its only exceptions are products at or under 0.3 percent THC on a dry weight basis and FDA approved drugs.

On mail, USPS Publication 52 section 453.37 allows hemp based products only when the THC concentration stays at or under 0.3 percent and the mailer keeps compliance records for two years. A licensed Maine can does not qualify.

Driving is simple. Maine has no per se THC blood limit, but impaired operating is covered by Title 29-A, section 2411. An open container of cannabis in the passenger area is prohibited. Put the can in the trunk.

Myth: a seltzer is fine in public because you are not smoking

That one costs people money. Maine's public rule is about consumption, not only about smoke.

Smoking gets the extra layer. Portland banned smoking in more than 50 parks and public grounds from 6 March 2013, and the Bangor Daily News reported the Eastern Promenade was on the list, with a 50 dollar citation. Our guide to where you can smoke in Maine covers that ground properly.

Drinking is still consumption. Sipping a can on a bench is a civil violation under section 1501, with a fine of up to 100 dollars. If you are visiting, Maine cannabis laws for tourists and our page on cannabis friendly places to stay in Maine will save you the fine.

Who should skip hemp derived THC drinks?

Anyone who wants to know exactly what is in the can. That is the trade-off in one line.

Hemp drinks are cheaper and easier to find. In exchange you give up the serving cap, the batch testing, the tracked supply chain and the state label rules. For a first timer, that is a bad swap.

Skip them too if you are traveling and need a stable answer about legality. The federal date has already moved once this year.

Frequently asked questions

Are THC drinks legal to buy in Maine without a medical card?

Yes. Maine runs a separate adult-use program, and any adult 21 or older can buy a licensed THC drink with a valid government photo ID. No card, no doctor, no registry. Rose Mary Jane holds an adult-use license only, so we cannot serve the medical program. Hemp derived drinks also carry a 21 and over sale rule in Maine, set by Title 7, section 2231, since June 2025.

How much THC is in a legal Maine THC drink?

A licensed Maine beverage is capped at 10 mg of THC per serving and 200 mg per package. The package cap moved from 100 mg to 200 mg in October 2023. Most cans on our shelf sit at 5 mg or 10 mg, because that is one serving. Multi serving bottles exist, so read the label and work out how many servings the container holds before you pour.

Is a hemp derived THC seltzer from a gas station legal?

It depends on the product and the date, and that is the honest answer. Maine law bars selling potentially intoxicating hemp products to anyone under 21. It sets no milligram cap and no state lab testing requirement for the finished drink. Federal law is mid change, so the national picture keeps moving. Call us before you stock up for a trip and we will tell you what we know that week.

Can I drink a THC seltzer on the Eastern Promenade?

No. Maine allows cannabis consumption in a private residence or on private property not open to the public with the owner's permission. A city park is neither. Drinking one on the Eastern Promenade is a civil violation with a fine of up to 100 dollars. Portland also bans smoking in more than 50 parks and public grounds, and the Eastern Promenade is on that list.

Can I fly home from Portland with a THC drink?

Leave it here. TSA says its officers do not look for drugs, but they refer anything illegal they find to law enforcement. Cannabis is still federally controlled, so a licensed Maine can has no federal protection at a checkpoint. TSA makes an exception only for products at or under 0.3 percent THC on a dry weight basis and for FDA approved drugs. Drink it before you drive to the Jetport.

Does Maine tax THC drinks differently from beer?

Yes, and the cannabis rate went up this year. Maine's adult-use cannabis sales tax rose to 14 percent from 1 January 2026, up from 10 percent. That applies at licensed stores like ours. Hemp derived drinks sold in a convenience store are not taxed under the adult-use cannabis structure at all, which is one reason the shelf price can look lower than ours.
